100+ snagging list in Taylor Wimpey new home

We moved into our new Taylor Wimpey home back in June 2012
We had a friend who is a site foreman for another company do our snag as we felt that there were so many we were starting to imagine them!!

Window reveals being inches out
Our boundary fence was in the wrong place
Plastic still on windows outside
Tiles layed on floor wrong way round
Tiles on bathroom walls broken
10 windows scratched
Carpets not fitting
Render failing !!

I could go on

The builders have admitted they rushed to get us in, and wanted to come in and put right...we let them and over 9 weeks we had builders in most days.. they made more mess or damaged more things than they put right !!

We are stll 100+ snags faults waiting to fixed.
Constant letters and even one to the MD, they have said they will fix but not willing to pay compensation.
They have agreed to make good and will have to move us out to do so !!!!
This does not help us as a family, for all the upset, inconvenience and disappointment that they have caused.
Should we let them move us out before we have agreed a package ?
Should we now be using a solicitor?
Any help much appreciated

Taylor Wimpey are a big plc house builder that state:
"we are dedicated to delivering excellence in the design and construction of our new homes and have a long history of delivering a high level of customer care"
Clearly the reality is quite the opposite!
Your new home was snagged by someone in the industry and despite this, 9 months later it is still so bad Taylor Wimpey need to move you out to fix it!

You really do need to get a level of compensation agreed. 
However, it may be better to wait until Taylor Wimpey have completed everything (properly this time!) and then you will know how long it took and the level of inconvenience for you and your family.

In the meantime, write to Taylor Wimpey's CEO Pete Redfern  peter.redfern@taylorwimpey.com  and e mail Taylor Wimpey's UK Customer Services Manager michelle.grant@taylorwimpey.com  informing them that you have placed the matter in the hands of your solicitor who will be contacting them once the remedial works  have been completed with regard to compensation.

You could also write to the Consumer Code for Homebuilders and make a claim under the dispute resolution scheme (maximum claim £15,000, max claim for inconvenience £250). Please copy the NHBC in when you write to Taylor Wimpey.  They need top be made aware of the problems you are having so they can take action against Taylor Wimpey, increasing their warranty premiums to reflect the increased risk.

Thank you for your advice. We have already contacted Michelle Grant and she just forwarded our concerns to Taylor Wimpey East Midlands (Milton Keynes) who we were dealing with.
Just felt we were being ignored by her and Peter Gurr MD.
Have now appointed a solicitor and will be letting them deal with Taylor Wimpey as I dont think we can do this anymore....It is so stressfull and upsetting.

We have contacted NHBC and they are not interested as the builders have 'held their hands up' and offered to replace and fix all the faults.
They have offered to send us the Consumer Code for Housebuilders (still awaiting)

Would still like to know how our house was ever signed off by the builders....

I am surprised to learn that Taylor Wimpey have not given you a copy of the Consumer Code for House Builders.
Requirement 1.2 of the Code clearly states:
Requirement:-  "The Home Builder must display the Code and give, without charge, a copy to customers who ask for it and to all Home Buyers who reserve a Home."

Taylor Wimpey, along with many under house builders, are paying lip service to this watered-down over simplification the requirements of the Legislation under the Consumer Protection from Unfair Trading Regulations 2008 and The Business Protection from Misleading Marketing Regulations 2008.

The Code does enable buyers to use the Dispute Resolution Scheme to take action against a house builder in the first two years for £120 that you can get back when you win.
Only 14 buyers have done so thus far and the industry is taking this as a sign of how good they and their homes are! 
Warranty issues cannot be claimed but financial loss and poor service can.

You should keep on e mailing Taylor Wimpey CEO Pete Redfern. 
He gets paid the large salary and he should be alarmed that his senior managers and staff are letting his company's customers down to such an extent that they feel they have no other option but to take legal action.

The NHBC will help, whilst Taylor Wimpey may have agreed to fix the defects they have yet to do so, or do so properly.
This being the case the defects remain a warranty issue and Taylor Wimpey are failing to honour their warranty obligations which the NHBC need to be kept informed, especially as this is going to court.

Your house is not 'signed-off' by the builder.
It should have been properly inspected and snagged at each stage of the building process. In reality any such inspections are limited to a few stage inspections by the warranty provider and Building Control Inspector - often the same person.
The most the home is inspected is when it is complete, even then, most house builders appear happy to say the home is 100% finished to a reasonable quality. 
The only signing-off that matters is the CML final inspection. 
This should flag up RED items (usually defects relating to safety) that require rectification before the certificate is issued and GREEN items that are minor and must be fixed within a week.
Sometimes when there are too many Green items then the certificate may be withheld depending on the inspector's opinion.

But there have been cases of new homes being signed off for CML with sections of roof missing and incomplete kitchens.

In the end, it is all the more vital that every new home buyer reads the Consumer Code before reserving, and has their home independently professionally inspected by a snagging inspector before legal completion.

Rushing to get finished ....especially at peak times such as month /quarter and year end ......has become the industry standard in recent years.

All along the employee chain ...bonuses depend on number being finished in time  for year end figures.

Quality is a secondary factor.
