WHAT AM I EXPECTED TO LEAVE?
« on: February 15, 2014, 10:28:54 pm »
I'm part exchanging with Taylor Wimpey.
As an incentive to buy the sales team chose a kitchen upgrade for the property.
So being in the process of buying, I have had no say in the kitchen or appliances, tiles anything.
I was informed that I would be expected to leave my appliances in my present house as I wouldn't be able to fit in my cooker.
Taylor Wimpey expect me to leave in a brand new cooking range, I thought it would be up to me if I wanted to sell it privately but with Taylor Wimpey being my buyer apparently not.
Has anyone come across this, I have nothing in writing.

Not quite sure what you are asking here.
Are you saying that Taylor Wimpey have fitted a new kitchen and appliances in your existing house?  Perhaps so they could sell it easier?  This does seem a strange thing to do though.  Regarding what you leave in your existing home is up to you and you should complete a form from your solicitors. Taylor Wimpey can offer you less if you keep the appliances or pay extra from them its all negotiable!  but........
DO NOT USE A TAYLOR WIMPEY RECOMMENDED OR SUGGESTED SOLICITOR!.

Or are you saying that Taylor Wimpey made all the choices for the kitchen etc in your new house?
It is possible if it was a stock unit. They are hardly going to rip out a perfectly good kitchen just because you want something different!  As a stock unit with sales selecting the kitchen etc, it is very likely that Taylor Wimpey have had trouble selling this particular home for one reason or another.  It's probably why you have been offered part exchange.

You could negotiate better deal, or if you haven't exchanged you can always walk away and Taylor Wimpey have to refund your reservation fee under the Consumer Code for Home Builders.

Welcome to the Taylor Wimpey world, where nothing is apparently straightforward!

Sorry I didn't make myself clear, its the second scenario.
Taylor Wimpey as the buyer of my property, say I have to leave appliances in my present address.
I thought they may have been mine to sell as I wanted.  I don't seem to be able to negotiate anything with them as they had upgraded the kitchen in the new house as a incentive to buy, fortunately I like the kitchen.

Taylor Wimpey obviously class the appliances as "fixtures and Fittings" and as such they should be part of the overall price, especially if they are built-in.
