Leak in ceiling of ground floor apartment

We have just bought a brand new apartment.  We have a boxed in beam in the corner of the kitchen ceiling which shows damp patches on the plaster finish.  A hole has been made in the box to look inside and water can be see coming in when it rains.  The plumber sent by the snagging team cannot locate the leak.  At first he thought it was coming from the balcony above but now is not sure.  Do the builders have to fix this Leak?

Yes they do!
You have a leak. Whatever the cause and however long it takes or however expensive it is the housebuilder has a responsibility under the warranty to fix this defect.

As you have a ground floor flat it is highly likely the leak is from the balcony above.  Failing this it is a plumbing leak from the flat above.

No home should let in the rain, especially a brand new home!
