We’ve just had our new build home demo with Gleeson.
We noticed the toilet was off centre and too close to the bath. They said it’s the bath box and it cannot be changed as there is piping in the bath boxing and it cannot be moved and can’t be rectified. The top of the toilet literally touches the bath box. Very frustrating.

Also, I didn’t realise our garden was sloped which isn’t a big deal. But I believe it’s potentially covering the Damp Protection (bottom bricks of the house) I can also show our signed site plan as there was no indication of a slope which I can see but maybe someone can?

Any help you could give would be amazing.

I really hate it when new home buyers are told "nothing can be done" about an obvious defect.
What the translation is: "that it would be too expensive and time consuming to rip it all out and do it again."

The only nothing can be done is when a person dies and the doctors cannot bring them back.  In every other respect there is always SOMETHING that can be done.

I suspect that in your case, the bathroom is smaller than it should be and/or the pipework now boxed in was in the wrong position. It is unacceptable that the WC seat hits or nearly hits the bath pipework boxing.

I suspect that there is a lot more wrong with your home and strongly suggest you have it professionally snagged and inspected before you legally complete and move in and do not do so until all remedial works listed have been dealt with.

The DPC should be 150mm which is two courses of bricks above finished ground level all around the house. If the ground slopes down towards the house it is likely that some ponding (flooding) will take place from time to time which does not comply with NHBC standards.
