Non-disclosure
« on: August 03, 2019, 07:14:13 pm »
Hi everyone, we are new to this site.

We are hoping that someone can help us or give us some advice. We bought a new build bungalow almost two years ago now. After we moved in we found damaged roof trusses. We contacted the builder who said the repairs had been done. It turns out he was talking about roof felt that was dropped and damaged the trusses. He states they never saw the other damage, which must have been caused by the folk lift.

After this discussion he then presented us with paperwork to say the roof had been repaired to manufacturer's instructions. When we asked would we need to pass this on to any prospective buyer they did not reply. We found out, we would need to disclose this or we could be sued. We were advised to contact our insurance company to tell them of the repair. We are devastated to find out that our insurance will not insure the roof, because it is a pre exsisting repair. We have contacted other insurance companies and they will not insure us. Please can anyone help or advise us.

It is ridiculous for any insurance company to say they will not insure a roof that has been repaired.

You would need to disclose details of any and all warranty work carried out on your home to any prospective buyer.  If the work has been completed properly this would not be a problem.

You need to be sure that your roof is repaired to correct, industry standards and I would suggest you get an independent structural engineer to write a report for you confirming this one way of the other.
If further works are needed, the housebuilder should carry out these and reimburse the cost of your report. If all is OK then you have independent report confirming this.

Quiet why a forklift would be needed to lift roof trusses onto a bungalow I don't know.
